Terms of Service

By commissioning me you agree to all of the following terms of service, commissioners are fully responsible for reading and agreeing to this TOS before commissioning me, and I am not responsible for results caused by the failure to read my TOS. Upon me receiving your payment, you have legally signed and agreed to my terms of service.
Active as of February 19th, 2024.I have the right to refuse or refund any commission without explanation.
I reserve the right to use all commission earnings before completion of the project, I use commissions to help pay my bills so often that is needed.
I have the right to alter or add to these terms at any point in time.
I have the right to post, edit, or use my commissioned art as examples, for NSFW works specifically you may request for them not to be posted and I will respect your request.
I have the right to set my prices however I please, I often do discounts but do not request for a discount.
I have the right to refuse a refund to those who commissioned physical products, this is due to the fact I work with a manufacturer. If there is an issue with your physical commission that was not made by hand myself then you cannot receive a refund or partial refund from me. If you have an issue with your physical commission, please contact me with the problem and we can work together to contact my manufacturer with your issue. If my manufacturer cannot fix your issue, I cannot provide any further help.The rights to each personal commission belongs to myself and the client who paid for the art.
I have the right to ask commissioners to use the artwork as a print, keychain, sticker or other merchandise with proper credit and compensation, commissioners have the option to say no with no questions asked.Commissioners have the right to:
repost any artwork as long as I receive clear and proper credit
use my art to bring awareness or share positivity
use my art for non commercial purposes.
edit, or request edits to any art made after it is marked as completed, despite any changes made by the client you may not remove my credit if you choose to repost or share.
ask for incorrect markings or changes for their art if something was missed or incorrect
color and line sketches made by me with permission (just send me a dm and give me a heads up! i still require credit if being posted or shared)Commissioners may not:
Use my art commercially, if you want to use my art commercially, please contact me and we can settle and agreement to where this can be changed.
Use my art for the purpose of training any AI program.
Use my art for the creation of NFTS.
Use my art for the promotion of hate or political standpoints despite what it is
Heavily reference or copy my designs or artwork.
request any changes to the composition or character once I begin making the art.
spam me about the completion of your art, i will personally send you any and all updates regarding your commission when it comes to it.
remove any bixxbyarks watermarks if added to the art.
request discounts on art or ychs.If you request a refund, you will receive it in full within 1 week of requesting. This includes partial refunds.
If you request a refund or I choose to cancel, your total refund will be calculated based on the amount of work completed.Chargebacks are handled very harshly, if you choose to file a chargeback rather than discuss the options for a refund with me you will be permanently blacklisted.
Any customs that are filed for chargeback will be reclaimed and resold.I have the right to block or blacklist anyone for any reason.PAYMENT OPTIONS

I am a full time student who runs a small business and also works a second job. I tend to get very busy and I cannot always prioritize art!
Commissions will be delayed if I am sick, traveling, or have important schoolwork If you choose to commission me at these times please be aware the expected completion date will be extended from what is mentioned before depending on how long I need a break. You will always be updated about the status of your commission and if there will be any delays!Manufacturing is out of my hands once the design is sent and paid for with my manufacturing company, after the art is approved changes cannot be made. I cannot be held responsible for any unnoticed mistakes after approval of the piece before manufacturing, I also cannot be held responsible for any mistakes the manufacturing company makes with your order. If you provide the incorrect shipping address, I will do what I can to get things fixed, but I cannot provide a refund for manufactured goods as it is taken out of the total commission price to pay for manufacturing. Commissioners of manufactured goods are responsible for all shipping costs. I am not responsible for manufacturing/shipping times. For all physical products, they are ordered in batches and shipped to my house all at once to save on shipping! From there, each commission is sent to their respective owners after the owner pays the shipping fees. If the commissioner does not pay the shipping fees, the commission will remain in my possession until they are able to pay.
